Upon submitting our check for 10% of the repair, we were told the work would begin in two weeks. Ten days later, we called the office to confirm the repair date, and were told it would be an additional two weeks due to delays caused by rain and because they didn't work on Thanksgiving Day, the day after, and the following Monday. Being that our drywall ceiling and floor are soaked every time it rains, time was of the essence. We decided to cancel our contract and look for another company who could complete the repair in a timely manner. We were told that we have to submit the cancellation via email, which we did, and requested our deposit refunded. The exact wording from Jim Parks, the owner was as follows:
CONSUMERS BEWARE...THE DEPOSIT IS NON-REFUNDABLE, using the guise it is an administration cost. You will not be made aware of this until after you cancel your contract in writing and ask for your refund.
His final response was: Two weeks approximation as stated by yourself was verbal, there is no other record of this conversation, though it is what we are giving upon inquiries, always, as the weather permits. All of those who have authorized a contract and provided a deposit will be told the same. Please accept this explanation as our final decision, we will not reply to any further inquiries or threats.
Our email back to him was: Nowhere on your estimate does it state that deposits are non refundable. I expect my full deposit to be refunded, or I will pursue further action.
